Dominica Trademark registration
 
In Dominica the legal Basis is the Marks, Collective Marks and Trade Names Act 1999. Trademark protection is obtained by registration. It can also be acquired by sufficient public recognition. It is the first to use rather than the first to register who has the superior right.
 
Requirements
 
A trademark application has to be filed before the Roseau, Dominica by a local agent. A notarised power of attorney is necessary. Foreign applicants do not need a domestic registration.
 
Procedure
 
The application process includes a formal examination and an examination of distinctiveness, but no search for prior trademarks. It takes approximately 18 months from first filing to registration. After registration the trademark is published. The opposition period is 2 months from the publication date of the registration.
 
Duration
 
A trademark registration in Dominica is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years. Existing registrations keep their term of 14 years until their next renewal.

Duly note, if the trademark has not been used within 3 years from registration or has not been used later for a continuous period of 3 years, it may be subject to cancellation.
