Mexico Patent Requirements
                
 
In order to apply and file for a patent in Mexico you need to provide 1. Patent Information, and you need to send to the Attorney the 2. Power of Attorney and the 3. Assignment Document if required.
 
 1.- Mexico Patent Requirements
 
1.    Name and address of the applicant. If it is a Company, place of incorporation.
2.    Name, address and citizenship of the Inventor(s).
3.    Invention Title, Abstract of the Invention, Utility Model or Design.
4.    Invention, Utility Model or Design specifications / description.
5.    Claims.
6.    Formal Drawings.
7.    A Spanish Translation of the specifications is required.
8.    Assignment agreement if applicant is different than the inventor.
9.    Certified priority document, including priority number and country of origin, accompanied by a Spanish translation (The priority could be claimed if the foreign patent application was filed within 12 months). The priority document should be presented within 3 months from the filing date.
 
The patent filing could be presented with the information from 1, 2, 3 and with copy of the original foreign patent information, priority information including date and number.
 
2.- Power of Attorney
 
The Power of Attorney does not need to be notarized or legalized, however it requires the signature of two witnesses.
 
The power of attorney, certified copy of the first patent application, assignment document should be presented within 2 months from the patent filing date.
 
 
 
 3.- Patents in Mexico
 
Concession of the Patent Grant: 20 years (from the filing date)
Concession of the Utility Model: 10 years
Concession of the Industrial Design: 15 years
Approximate Patent Application processing time: 3 to 5 years.
Approximate Utility Model processing time: 2 years.
Approximate Industrial Design Application processing time: 1 year.
Member of the Paris Convention: Yes
Member of the PCT: Yes
Mexican Patent Office: Instituto Mexicano de la Propiedad Intelectual (IMPI)
 
4.- Application Process
 
1.    Patent Filing
2.    Preliminary Exam
3.    Publication in the Intellectual Property Gazette: within 18 months from the filing date. (Utility Model Applications are not published)
4.    Opposition Period: 60 days
5.    Formal Examination Request: request within 6 months from the publication.
6.    Acceptance or rejection
7.    Payment of the Final Taxes.
